Government Resources About Electing Public Officials

America’s democratic government is founded on citizen rights to vote for elected officials. The Federal government has produced a few recent resources to help keep Americans educated about the regulatory responsibilities that come along with electing public officials.

The Code of Federal Regulations – Federal Elections  provides current regulations published by the Federal Election Commission to include candidate status and designations (also cited in 52 U.S.C. 30102(e), compliance procedures (also cited in 52 U.S.C. 30109, 30107 (a), Federal contractors, corporate and labor organization activity, and a lot more.

If you work or are involved with corporations or labor unions, you may want to check out Campaign Guide: Corporations and Labor Organizations, which was recently published by the Federal Boards and Commissions.

These guidelines apply to people working within trade associations, membership organizations, human capital, and labor organizations. It outlines how organizations can set up political action committees (PACs), Hybrid PACs, and separate segregated funds (SSFs) to make political contributions. This guide also covers contribution limits. It offers legal guidance about accepting contributions or donations from a foreign national within a federal election campaign. It covers other restricted classes and how fundraising can be legally handled for Federal election campaigns.

This text also covers the requirements for electronic filers. Anyone computer savvy who works within corporations and trade associations, owns their own small-to-mid-sized business, or is part of a lobbyist firms, could learn from this publication. It advises the reader on how to keep receipts and report donations that may impact the election process through campaign financing.

Here’s hoping this blog post will help educate you about resources available to assist you with legal ramifications with Federal elections and proper (allowable) methods to make campaign finance donations.

Headline: Campaign Trails to the United States Federal election process

voteThe United Kingdom recently completed their Prime Minister election, and now, the American candidates are aligning for Presidential, Congressional, and Delegate elections to take place in November 2016.

As a result of the candidates’ campaign strategies, many potential voters within the United States of America are beginning to witness campaign advertisements on their local and cable television stations. The news media also has begun their weekly coverage of the nominees’ activities- including their viewpoints on topics currently impacting American culture in the workplace, economy, and personal struggles. Candidate telephone calls and mailings about candidates are beginning to make their way to the general citizen as well, in hopes for their votes in this next pivotal election.

Designing a Nation: Civic Art in the Nation’s Capital

The U.S. Capitol and National Mall are a beautiful representation of the dignity and public spirit of the United States of America. This area is steeped in history, and you can learn more about the past and continued efforts to design, build, and preserve the U.S. Capitol and National Mall through many government publications.

Brumidi-To-Make-Beautiful-the-CapitolWith its famous dome celebrating its 150th anniversary in December 2013, the United States Capitol is a treasure-trove of civic art. Just released, To Make Beautiful the Capitol: Rediscovering the Art of Constantino Brumidi gives a detailed history of renowned Italian-born artist Constantino Brumidi’s masterful work in “making beautiful” the walls and ceilings of the United States Capitol in a span of 25 years starting in 1854. Every page delights with gorgeous, full-color photographs and images of Brumidi’s art, from photographs of the frescoes and decoration, to sketches, paintings and images of the artist, particularly the Brumidi Corridors and his “monumental fresco” in the Capitol Rotunda, called The Apotheosis of Washington. Fascinating anecdotes are included throughout of the artist and the inspirations he received for various elements, his relationship with engineer Montgomery C. Meigs, and the conservation efforts to preserve his work accurately for posterity. The primary oversight board for projects in the National Mall area is the U.S. Commission of Fine Arts, which was established by an act of Congress on May 17, 1910 in Public Law 61-181. This commission was created as an independent review agency for the work of designing the national capitol and to guide the architectural development of Washington. The commission’s role was expanded with later passage of the Shipstead-Luce Act of 1930 (Public Law 71-231 and Public Law 76-248), and the Old Georgetown Act of 1950 (Public Law 81-808). The U.S. Commission of Fine Arts has a long history of guiding the development of the nation’s capital. Several resources are available in print and online to learn more about the commission’s history.

The National Park Service maintains a detailed guide linking to documents and reports that detail the area history. The Mall Cultural Landscape Inventory, part 2 contains several pages describing the history of the Senate Park Commission and its formation into the U.S. Commission of Fine Arts.

Designing-the-nations-capitalThe U.S. Commission of Fine Arts published a monograph in 2006; Designing the nation’s capital: the 1901 plan for Washington D.C. This 359 page monograph contains illustrations in color and black and white, as well as maps. The National Park Service provides full text access to this title online.

In addition to this title, several editions of this history of the U.S. Commission of Fine Arts from 1910 to date were published in 1964, 1977, 1981, 1985, 1991, and 1996.

Civic Art : a centennial history of the U.S. Commission of Fine ArtsThe most recent addition to the volumes available about the history of the commission is celebrates 100 years of the work of the commission. Civic Art : a centennial history of the U.S. Commission of Fine Arts is a beautiful, 626 page monograph with illustrations, maps and plans. It is a comprehensive history of the agency and includes original essays by prominent architects and landscape architects including Arleyn Levee, Carroll William Westfall, and Richard Guy Wilson.

A Botanic Garden for the Nation: The United States Botanic GardenAnother beautiful book that features some of the history of the national mall area is A Botanic Garden for the Nation: The United States Botanic Garden. America’s Castle: the evolution of the Smithsonian Building and its institution, 1840-1878To read more about the history of the Smithsonian, you could visit a depository library and check out the publication, America’s Castle: the evolution of the Smithsonian Building and its institution, 1840-1878.

If you are interested in the official records of the commission, you can locate them at the National Archives. The record collection includes administrative history, annual reports, and a selection of still photographs. The records are divided between College Park, MD and Washington DC. Many of the records pertaining to the building and continued development of the National Mall are available at the National Archives, such as the National Park Service Records for the National Capital Region, and the Records of the Office of Public Buildings and Public Parks of the National Capital.

Watching our weight and eating better were definitely on the minds of Americans this year as Diet & Nutrition books and posters were best sellers, including:

Federal Books that Shaped Work in America

Federal Government Books that Shaped Work in America, a collection about employment, careers, occupations, job hunting by the US Government BookstoreThe end of the calendar year typically provokes many lists and reviews reflecting on the past. Here at the Government Printing Office’s Government Book Talk blog and the U.S. Government Bookstore is no exception. A few weeks ago, we were contacted by Mike Volpe at the Department of Labor (DOL) about an exciting and relevant initiative they are running in honor of the Labor Department’s Centennial in 2013 that looks back on the important work-related publications across the country.

According to Carl Fillichio, Senior Advisor for Public Affairs and Communications at the U.S. Department of Labor and chair of the Department’s Centennial, the Department of Labor is developing a list of Books that Shaped Work in America in partnership with the Center for the Book in the Library of Congress.

MICHELE BARTRAM, Government Book Talk Editor: Carl, I understand that a Library of Congress “Books that Shaped America” exhibition in 2012 was the inspiration for the Department of Labor project. What was the relationship between the two and how was the idea born for the DOL version?

CARL FILLICHIO:  The Labor Department was not actually involved in the “Books that Shaped America” exhibition at the Library of Congress, other than being big fans of it!  Rather, it served as the inspiration for this project.  The number and wide diversity of books on that list that had work as a central theme really impressed upon us the role that published works have played in shaping American workers and workplaces.  That’s how the idea for this project was born.

BARTRAM: What is the goal of this new DOL project? What do you want citizens to get out of it?

FILLICHIO: The goal is to engage and educate the American public about the Labor Department’s mission, resources and history in our centennial year in an unusual way: through a lens of literature.  The project is a key part of our Centennial commemoration; the Department was established in 1913.  So we thought this would be a “novel” [pun intended! ;-)] way to involve the citizens we serve in the marking of this milestone.

For each book included on the list (now and in the future), we note how its themes relate to our work.  We hope citizens will learn more about what we do and consider the many ways our work has impacted Americans’ lives during our 100-year existence.

BARTRAM: What are the criteria for adding items to the list? Can they be eBooks as well as print? Do they need to be still in print?

FILLICHIO: Just like work, books have changed a lot in the last 100 years—not only in the themes they address, but also in how we access them!  So, books do not need to be in print to be on the list.  We started the list with 92 entries, all recommendations from various contributors with diverse perspectives on books and/or work (including almost all former living Labor Secretaries).  We will now add to it based on public input.

To be added to the list, the book needs to have had an impact on America’s workers, workplace and workforce.  That doesn’t necessarily mean it has to be about work per se, but rather have shaped how it is viewed or, in some cases, addressed through public policy.

FILLICHIO: That’s a great question, Michele!  As noted earlier, not all books on the list are overtly about work, and one great example is Little Women, which was recommended by a Labor Department intern, Amanda Kraft.  While there are several books on the list that touch upon working women, that one—published in 1869—sticks out to me because it was so ahead of its time.  It was about women and ambition—long before women were “allowed” or encouraged to be ambitious.  It had and continues to have a big impact on working women.

BARTRAM: “Little Women” certainly influenced me. Do you have some other fun facts about the project you’d like to share?

FILLICHIO: Here are a few fascinating facts:

  • We started with 92 books based on recommendations from 25 contributors.  These contributors run the gamut from the current and former Labor Secretaries to best-selling authors to small business owners.
  • The books range in publication date from 1758 (Poor Richard Improved, by Benjamin Franklin) to 2013 (My Beloved World, but Sonia Sotomayor).
  • One of the books recommended by the current Labor Secretary, Thomas E. Perez, is Busy, Busy Town—a classic children’s book that introduces very young readers to the purpose and value of work, to both oneself and others.
  • We have received nearly 500 recommendations for books to add to the list so far.

Federal Books to Identify Industry and Career Trends

Not surprising, many of the more important Federal books about work have come from the Department of Labor, from information about occupations and industries to advice to job seekers.

The DOL’s Employment and Training Administration has designed a set of self-directed career exploration/assessment tools to help workers consider and plan career options, preparation, and transitions more effectively. They also are designed for use by students who are exploring the school-to-work transition. These tools are based on the O*NET model built off the Labor Department’s O*NET database which contains information on hundreds of standardized and occupation-specific descriptors. The O*NET Content Model defines the key features of a particular occupation with its unique mix of required knowledge, skills, and abilities, activities and tasks, and describes the day-to-day aspects of the job and the qualifications and interests of the typical worker.

  • A Life Inspired: Tales of Peace Corps Service recounts the unique experience of being a Peace Corps Volunteer via autobiographical reminiscences by 28 former Peace Corps volunteers.
  • Book Cover Image for Standard Occupational Classification Manual 2010 (Revised)The Standard Occupational Classification Manual 2010 (Revised) by the Executive Office of the President, Office of Management and Budget (OMB) presents the standard occupational codes, structure, titles, definitions, and illustrative examples of job titles found in key occupations.
  • Unfortunately being discontinued next year as a formal publication is the Survey of Current Business subscription by the Commerce Department’s Economics and Statistics Administration Bureau of Economic Analysis. This key publication was critical to business planning as it provided national income and product statistics, including the U.S. Gross National Product, the GNP implicit price deflator and corporate profits and articles about trends in industry, the business situation, and outlook.

The existence of the Occupational Safety and Health Administration or OSHA within the Labor Department and the subsequent laws and regulations it oversees to improve workplace safety and worker health has drastically improved working conditions for generations of American workers. Over the years, OSHA has published a number of publications for both industry and workers. All About OSHA (Package of 25 booklets)Today, it publishes All About OSHA (or Todo Sobre la OSHA (Spanish Language Version), a brochure explaining how OSHA operates, workplace and worker safety standards and enforcement, required employer recordkeeping, OSHA services and programs, and even whistleblower protections.

NIOSH, the National Institute for Occupational Safety and Health, offers the NIOSH Pocket Guide to Chemical Hazards to help workers and employers detect and prevent chemical accidents.

Reclamation Safety and Health StandardsA similar publication exists from the Department of the Interior’s Bureau of Reclamation. Reclamation Safety and Health Standards contains safety and health standards for workers in water management facilities and hydroelectric power plants.

The Army Medical Department produces a number of excellent publications about working conditions and health of the military personnel. Textbooks of Military Medicine, Pt. 3, Disease and the Environment: Occupational Health, The Soldier and the Industrial Base gives information on occupational health of military personnel.

Examining man-made disasters and their causes and remedies is a key role of Federal Government. One of the more important publications affecting regulations and Americans’ attitudes toward offshore drilling was the 2011 Deep Water: The Gulf Oil Disaster and the Future of Offshore Drilling, Report to the President (in paperback) or ePub eBook.

Veterans’ rights and benefits are outlined in the annual Federal Benefits for Veterans, Dependents & Survivors, offered in English or Spanish, that includes work-related issues such as vocational rehabilitation; workplace benefits; and education, transition and training.

Invest in Women, Invest in America: A Review of Women in the U.S. EconomyWomen in the workplace were addressed in these two key publications that are still available. The Joint Economic Committee of Congress published Invest in Women, Invest in America: A Comprehensive Review of Women in the U.S. Economy that provides a comprehensive review of the “essential contributions of women” to the U.S. economy. The Bureau of Labor Statistics published Women in the Labor Force: A Databook which presents historical and current labor force and earnings data for women compared to men from the Current Population Survey.

Government eBooks Made Easy– and Sometimes Free

Riding on Washington, DC’s Metrorail subway system these days, one sees more electronic devices in hand than print books (the same is true when I was in New York, Chicago, San Francisco and across the country). This reflects the revolution going on in the publishing industry nationwide with the astonishing growth of ebooks.

According to Publisher’s Weekly, Bowker Market Research found that for the first half of 2013, e-book sales in the United States accounted for 14% of consumer dollars spent and 30% of all the units sold of any format of books.

The Rumors of [Print’s] Death are Greatly Exaggerated

However, print is far from dead. In fact, hardcover book sales in the U.S. were up over 10% through the first eight months of 2013, according to the latest numbers from the Association of American Publishers. And many users still prefer print for reference and textbooks.

When media research firm Voxburner questioned sixteen to 24-year-olds about their preferences for physical products versus digital content, printed books jump out as the media most desired in material form, ahead of movies (48%), newspapers and magazines (47%), CDs (32%), and video games (31%).

The two big reasons for preferring print are value for money and an emotional connection to physical books. On questions of ebook pricing, 28% think that ebooks should be half their current price, while just 8% say that ebook pricing is right. The top-rated reasons for preferring physical to digital products were: “I like to hold the product” (51%), “I am not restricted to a particular device” (20%), and “I can easily share it” (10%).

Remembering Camelot: Best of the old and new official publications about John F. Kennedy

For the World War II generation, it was December 7, 1941 that was a “date which will live in infamy.” For today’s Americans it is September 11, 2001. For my parents’ generation, November 22, 1963, is the infamous day that everyone remembers where they were when they heard the news that President Kennedy had been shot. The assassination of President John F. Kennedy is one of the most historic—and horrific— days of the 20th century, and its impact is still being felt today.  It’s hard to believe it has been 50 years this week since the tragic events unfolded in Dallas, Texas.

In commemoration of this important milestone in our Nation’s history, the U.S. Government Printing Office has assembled a number of Official Federal publications that help us reflect on the huge legacy left by “JFK” in his short but impactful 1,000 days in office.

Civil Rights and the Brothers Kennedy

After the Supreme Court ruled unanimously in Brown v. Board of Education in 1954 that racial segregation in public schools was unconstitutional, desegregation was a slow process in many Southern school districts and universities.

By President Kennedy’s election, civil rights activists were pushing for more equality, resulting in violent attacks and confrontations by staunch segregationists that required Federal involvement such as Federal marshals being called in by JFK’s brother and Attorney General Robert Kennedy to protect Alabama freedom riders, as well as forced integration at “Ole Miss” University of Mississippi.

The End of Camelot

The practice of referring to the Kennedy Administration as Camelot came from a post-assassination interview for Life magazine with First Lady Jacqueline (Jackie) Kennedy, who referred to the years of Kennedy’s presidency before his assassination as an “American Camelot.”  She said that President Kennedy was fond of the music to the popular 1960-63 smash Broadway musical, Camelot, the lyrics of which were penned by Kennedy’s Harvard classmate, Alan Jay Lerner.  The First Lady mentioned that the President and she often listened to a recording of the hit title song before going to sleep, with JFK  particularly enjoying the phrase: “Don’t ever let it be forgot, that once there was a spot, for one brief shining moment that was known as Camelot.” Once the article was released, other journalists picked up on Mrs. Kennedy’s reference, and the world has used it ever since.

First Ladies by the White House Historical Association ISBN 9780912308838Jackie Kennedy’s historic role as First Lady is outlined in the beautifully done First Ladies of the United States of America book by the White House Historical Association which profiles the many courageous First Ladies, from Martha Washington to Jacqueline Kennedy, up to Hillary Rodham Clinton and Laura Bush.

The end of Camelot came with President Kennedy’s assassination by Lee Harvey Oswald. Afterwards, President Lyndon Johnson created a commission, chaired by Chief Justice Earl Warren to investigate the events that led to the assassination and any possible conspiracies.

The U.S. Government Printing Office (GPO) produced, in what was perhaps its single most important publication of the 1960s, the official results of this investigation in the Report of the President’s Commission on the Assassination of President Kennedy.  It became known unofficially as the Warren Commission Report or the Warren Report, named for Supreme Court Chief Justice Earl Warren who chaired the commission.

Before it was released to the public on September 27, 1964, special security measures were set up at GPO to prevent any unauthorized disclosure of the manuscript.  A half century later, GPO is releasing a FREE digital version of the full, 900-page original Warren Commission Report from GPO’s FDsys (Federal Digital System) database.

Today it is still fascinating to re-live the events surrounding the events in Dallas in 1963 from eye witnesses.  In addition to witness testimony, the Report contains numerous photos, maps, diagrams, and illustrations.

The post-President Kennedy assassination audio tape recordings of conversations between various individuals in Washington, DC, and Air Force One pilots and officials on board during the flight from Dallas to Andrews Air Force Base are also available on FDsys.

Why Americans Should Care about Long-Term Care

Commission on Long-Term Care Final Report from September 2013 available from GPO.govThe Commission on Long-Term Care has formally released its Final Report to Congress in which it endorsed a package of 28 recommendations “for addressing our nation’s challenges with delivering and financing long-term care services and supports (LTSS).” Today it is also available from GPO.

Why Long Term Care is an Issue

With U.S. Baby Boomers entering retirement age, every day more than 10,000 Americans reach the age of 65. In five years, over 50% of the U.S. population will be over the age of 50. As Americans live longer, more of us will need long-term care either with at-home services or nursing homes or other extended care facilities. The estimate is that over 12 million Americans need LTSS today, and 27 million will need long-term care by 2050 (see image from the Report below).

Finding and paying for quality long-term care is a growing challenge for most Americans, as the Commission’s report clearly demonstrates, particularly for frail older adults or people with disabilities and middle class families who do not qualify today for Government assistance like Medicaid. Likewise it is a concern for local, state and Federal lawmakers, since the report says that many people lack the necessary savings to pay for the high cost of this care along with regular health care costs, and that Medicare and Medicaid alone cannot cover the growing needs. How expensive is long-term care today? The latest report from Genworth Financial estimates that middle class families would have to pay on average $18 per hour for homemaker services, $19 an hour for home healthcare aides, $3,405 a month for assisted living facilities, and around $230 a day for a room in a private nursing home. The Commission’s report calculates that 25% of today’s 65 year-olds can expect to pay from $10,000 to over $100,000 or more on long-term care services in the future! (See image below).

The Commission on Long-Term Care was established under Section 643 of the American Taxpayer Relief Act of 2012 (P.L. 112-240), signed into law January 2, 2013, to be comprised of fifteen commissioners. Three members each were appointed by the President of the United States, the majority leader of the Senate, the minority leader of the Senate, the Speaker of the House of Representatives, and the minority leader of the House of Representatives.

The statute directs the Commission to:

“…develop a plan for the establishment, implementation, and financing of a comprehensive, coordinated, and high-quality system that ensures the availability of long-term services and supports for individuals in need of such services and supports, including elderly individuals, individuals with substantial cognitive or functional limitations, other individuals who require assistance to perform activities of daily living, and individuals desiring to plan for future long-term care needs.”

The statute further directed the Commission within 6 months of the appointment of Commissioners (by September 12, 2013) to:

“…vote on a comprehensive and detailed report based on the long-term care plan… [described above]… that contains any recommendations or proposals for legislative or administrative action as the Commission deems appropriate, including proposed legislative language to carry out the recommendations or proposals.”

What’s in the Report?

In the opening letter of the report addressed to the President and Congressional leaders, the Commissioners broadly explain the Report’s contents:

“Working on a bipartisan basis, the Commission adopted 28 specific public policy recommendations in service delivery, workforce, and financing that set a strong path forward for transforming systems of care to best meet people’s needs while appreciating today’s fiscal realities.”

Among the 28 measures in the report, the recommendations included:

  • Expanding use of insurance policies that combine life insurance and annuities with long-term care insurance.
  • Using a Partnership for Long-Term Care in which arrangements are made between state and private insurers to enable long-term care insurance policyholders to retain assets equal to the amount of benefits paid under their policy and still qualify for Medicaid.
  • Increasing education efforts to enhance public knowledge about long-term care options, especially given “the limitations of Medicare and Medicaid in funding [long-term care services]”
  • Recognizing caregivers as members of “care teams,” including information about caregivers in patient records, assessing caregivers’ need for support, and making services like respite care more widely available.

With five dissenting members, the Commission explains that it included “two approaches” in its Final Report about how to finance a long-term care system (LTSS) in the United States. To find out more, you should read this timely and important report.

September 11 Tales of Heroes and Tough Lessons

Ask any American who was alive in the 60’s where he or she was when John F. Kennedy or Martin Luther King was assassinated and you will hear a stirring personal story. For our generation, it was September 11, 2001.

I was right across from the Twin Towers twelve years ago today, getting ready to board a ferry for my daily commute from New Jersey across the Hudson River into Manhattan, when I saw the second plane hit the World Trade Center right across from me. So, too, I cried with a group of strangers as we stood on the ferry platform and watched in horror as the first tower fall, saw the dust cloud rise and felt the earth—and the world—tremble.

America and Americans have changed since that day… twelve years ago today. We have since heard stirring stories of heroes and sacrifice, and learned many grim lessons that are still affecting both policy and people today.

Many of these stories of heroism, missed opportunities, and resulting actions have been painstakingly and faithfully chronicled by a wide array of Federal agencies, ensuring the sacrifices and lessons are not forgotten.

Responding to the Tragedies

Both in New York and the Pentagon in Washington, DC, we saw how first responders and medical personnel rushed to save lives. These excellent publications tell the stories of the heroes from that day:

The single must-read for every American about September 11 is the official version of The 9/11 Commission Report: Final Report of the National Commission on Terrorist Attacks Upon the United States. This publication lists the findings of the National 9/11 Commission, listing all the painful errors made leading up to the terrorist attacks and outlining specific recommendations for international, national, state and local changes in policy and procedures that the panel of experts felt needed to be implemented to ensure a similar attack never happened again. This seminal publication has served to inform all subsequent policies and legislation since 9/11. It is available in print or as an eBook.

The Senate, Select Committee on Intelligence, and House, Permanent Select Committee on Intelligence examined the intelligence failures leading up to 9/11 and jointly published the results in United States Congressional Serial Set, Serial No. 14750: Joint Inquiry Into Intelligence Community Activity Before and After Terrorists Attacks of September 11, 2001 With Errata.

This publication provides the findings from the post-9/11 FBI Terrorism Research and Analysis Project (TRAP) Symposium. TRAP is a leading research consortium made up of international/domestic academics and law enforcement officers, and is a working group sponsored by the FBI’s Behavioral Science Unit. In it, these counter-terrorism experts provide a better understanding of the causes of terrorist activity and possible government response tactics to mitigate terrorist actions.

All the President’s Men and Women: Sourcebook of the US Executive Agencies

The size of the federal government is a consistently politicized topic. Whether you think it is too big or too small or just right, you can learn more and develop an opinion with help from a first-of-its-kind publication by the Administrative Conference of the United States.

Sourcebook-US-Executive-Agencies-2012This first edition of the Sourcebook of the United States Executive Agencies was published in December 2012 to break down information and numbers by what they refer to as the “executive establishment,” which is the executive branch and all the other Federal agencies, offices, bureaus, and boards that serve the President that do not fall neatly under any of the three branches of the Federal government.

From Three to Many

The executive establishment traces its roots to 1789 when the first Congress created three executive departments: Treasury, War and State. For 60 years, these three departments carried out the nation’s essential functions and responsibilities regardless of whether they fit under the departments. Then in 1849, Congress created the Department of the Interior and after that the rest of the executive departments that we know today were established, reorganized and shuffled together over time. The Department of Homeland Security is the most recently established agency that was created in 2002 combining together 22 federal agencies from various departments.

Burgeoning Bureaucracy

Regarding the number of federal government employees, the most dramatic increase happened under FDR’s administration. During the New Deal era from 1933 to 1944, federal employment expanded from 600 thousand workers to 3.3 million workers.  In 2012, the executive establishment was made up of 2.85 million civilian employees compared to the legislative branch with 31 thousand civilian employees, the judicial branch with 32 thousand civilian employees and the military with 1.4 million service members.

These numbers do not include the number of contract employees and local and state employees whose salaries are paid for with federal funding.

The Role of the Political Appointee

The publication also explains the types of political appointees and their role in the executive establishment.  The top leadership positions in the executive establishment’s departments and agencies are political appointments that must be nominated by the President and confirmed by the Senate. In 2012, there were 1,130 positions in the executive establishment requiring Senate confirmation.

Another type of political appointee is the Senior Executive Service (SES), which is a corps made up of about 7,000 senior managers across the executive establishment. The Office of Personnel and Management determines the number of positions in each agency that will be filled by members of the SES. Then there are also Schedule C positions who serve at the pleasure of the head of the department of agency. Both SES and Schplum-book-2012edule C appointees do not require Senate confirmation.

BP in Hot Water over Deepwater

As the BP Oil Spill civil trial begins this week, the Federal Government will attempt to prove whether British Petroleum (BP) and/or any of its contractors such as Transocean (RIG), the owner and operator of the Deepwater Horizon oil rig, and Halliburton (HAL), which was responsible for pouring the cement plugs in the well, were “grossly negligent” and thus financially liable in causing the deadly BP Deepwater Horizon offshore oil rig explosion on April 10, 2010, and the blowout of the Macondo well.

The initial explosion killed 11 oil rig workers and triggered a subsequent oil spill which dumped millions of barrels of crude oil into the Gulf of Mexico, with the full extent of the long-term ecological and economic damage to the Gulf states and aquatic and wildlife still unknown.  With tar balls linked to the BP oil spill still washing ashore from Louisiana and Alabama to as far away as Australia, if BP is found “grossly negligent” instead of “simply negligent,” it will be on the hook for $17.6 billion in additional clean-up costs on top of the $4.5 billion fine for the criminal case settled in November 2012.

The National Commission on the BP Deep Water Horizon Oil Spill and Offshore Drilling produced two landmark and controversial reports about the oil spill causes and consequences that are critical in understanding the Government’s case against BP:

1)      Macondo: The Gulf Oil Disaster. Chief Counsel’s Report 2011, and

2)      Deep Water: The Gulf Oil Disaster and the Future of Offshore Drilling, Report to the President, January 2011.

THE MISSION

Established by Executive Order 13543 on May 21, 2010 by President Barack Obama, the mission of the National Commission on the BP Deep Water Horizon Oil Spill and Offshore Drilling Commission was to examine the relevant facts and circumstances concerning the root causes of the Deepwater Horizon explosion and develop options to guard against, and mitigate the impact of, any oil spills associated with offshore drilling in the future.

THE INVESTIGATION

Macondo-Oil-Spill-Report-9780160879630The first order of business for the Commission was to carry out the directive in the Executive Order to “examine the relevant facts and circumstances concerning the root causes of the Deepwater Horizon oil disaster.” They instructed the Commission‘s Chief Counsel Fred Bartlit and his investigative team to provide “the most comprehensive, coherent, and detailed account of the events leading up to the blowout and explosion” of Macondo, the name of BP’s offshore prospect in the Gulf of Mexico in the sector called the Mississippi Canyon Block 252, or MC252 where BP was drilling at the time of the accident.

The result was this report, Macondo: The Gulf Oil Disaster. Chief Counsel’s Report 2011, which provides additional details and documentation supporting the findings in the Commission’s final report.

The respected Library Journal, in selecting the Macondo report as one of its “Notable Government Documents” for 2011, said:

“The National Commission on the BP Deepwater Horizon Oil Spill was created by President Obama and charged with investigating the root causes of the largest accidental marine oil spill in the history of the petroleum industry. The committee concluded that the cause of the blowout was not mechanical. THE FINDINGS AND RECOMMENDATIONS

Deep-Water-Report-9780160873713The second and final report is the best-selling Deep Water: The Gulf Oil Disaster and the Future of Offshore Drilling, Report to the President, January 2011. It not only offers the full account of what happened in the Gulf of Mexico on April 20, 2010 and why, but also offers recommendations on proposed actions, changes in company behavior, reform of government oversight, and investments in research and technology that will be required to avert future disasters.

In Part I: The Path to Tragedy, “Chapters 1 through 3 describe the events of April 20th on the Deepwater Horizon, and, more important, the events leading up to it in the preceding decades—especially how the dramatic expansion of deepwater drilling in the Gulf was not met by regulatory oversight capable of ensuring the safety of those drilling operations.

In Part II: Explosion and Aftermath:  The Causes and Consequences of the Disaster, Chapters 4 through 7 lay out the results of the Commission’s investigation in detail, highlighting the crucial policy-related issues: the specific engineering and operating choices made in drilling the Macondo well, the attempts to contain and respond to the oil spill, and the impacts of the spill on the region’s natural resources, economy, and people—in the context of the progressive degradation of the Mississippi Delta environment.

In the final section, Part III: Lessons Learned: Industry, Government, Energy Policy, Chapters 8 through 10 present the Commission’s recommendations for reforms in business practices, regulatory oversight, and broader policy concerns.

Throughout the book, the Commission makes the case that outlines a number of primary conclusions, including these unsettling findings:

  • The explosive loss of the Macondo well could have been prevented.
  • The immediate causes of the Macondo well blowout can be traced to a series of identifiable mistakes made by BP, Halliburton, and Transocean that reveal such systematic failures in risk management that they place in doubt the safety culture of the entire industry.
  • Deepwater energy exploration and production, particularly at the frontiers of experience, involve risks for which neither industry nor government has been adequately prepared…
  • To assure human safety and environmental protection, regulatory oversight of leasing, energy exploration, and production require reforms even beyond those significant reforms already initiated…to ensure [the regulators’] political autonomy, technical expertise, and their full consideration of environmental protection concerns.
  • Because regulatory oversight alone will not be sufficient to ensure adequate safety, the oil and gas industry will need to take its own, unilateral steps to dramatically increase safety…
  • The technology, laws and regulations, and practices for containing, responding to, and cleaning up spills lag behind the real risks associated with deepwater drilling…
  • Scientific understanding of environmental conditions in sensitive environments in deep Gulf waters, along the region’s coastal habitats, and in areas proposed for more drilling, such as the Arctic, is inadequate. The same is true of the human and natural impacts of oil spills.

Delivered to the President on January 2011, the final report starts with a poignant dedication “to the 11 men who lost their lives on the Deepwater Horizon rig on April 20, 2010 and to their families, in hope that this report will help minimize the chance of another such disaster ever happening again.”

Losing our Shared National Experience?

Our blog post last week talked about GPO’s 150-year history of keeping America informed. But what does this mean in today’s media-saturated world?

Has the proliferation of media eroded our shared national experience?

Two weeks ago in a social media seminar for Federal Government, David Kirkpatrick (technology writer for the Daily Beast and Fortune magazine and author of a new insider book on Facebook) gave some startling statistics: 50% of Facebook’s 800 million users worldwide visit Facebook daily and up to 500 million have accessed Facebook on a single day, with the average Facebook user having over 130 “friends.”

But even more surprising, he said that 50% of Americans today now get their news and analysis about important events— sometimes edited or changed as it is passed along— from friends and family, often via social networks, text or email rather than from traditional media sources.

Prior to the 21st century, when Americans had only a few national media choices and limited local media, we would all receive the same original message at the same time, thus creating a shared American experience.

Today, in the U.S. alone Americans can choose to receive information from any of an estimated 1,476 daily newspapers; 1,500 television stations; 10,322 radio stations; 71 million cable television subscribers with hundreds of TV channels each; and more than 12 billion web pages and social media.

Kirkpatrick and others say the combination of the “Facebook effect”, media proliferation, and message selectivity have contributed to the erosion of our common, shared national experience.

GPO’s role in preserving our common American experience
